ITIN Renewal and Expiration: Has Yours Expired?

One rule decides it, and it takes thirty seconds to check. Here is the rule, the way to test your own number against it, and what a return filed with a lapsed ITIN actually costs you.

The rule, in one sentence

That is the entire test. There is no expiry date printed on your CP565 notice, no online lookup, and no separate schedule to consult. The IRS is asking one question: has this number been used on a return recently enough to suggest it is still needed?

How to check whether yours has expired

  1. Look at the 2023, 2024 and 2025 federal returns
    Your own returns, or a return somebody else filed that listed you as a spouse or dependent. Either counts.
  2. Ask whether your ITIN appears on at least one of them
    Not all three. One is enough. It can be any of the three.
  3. If the answer is yes, the number is current
    Nothing to do. Carry on.
  4. If the answer is no, it lapses on December 31, 2026
    Renew before you next need to file with it. Renewing early costs nothing and saves the January queue.
A return you filed but that was never processed does not count. If a return was rejected, returned, or never actually reached the IRS, the number was not used on a filed return. If you are unsure whether a year was genuinely filed, request a transcript or call the IRS on 800-829-1040 before assuming your number is safe.

What happens if you file with an expired ITIN

This is the question worth having a straight answer to, because the fear — that the return is thrown out — is worse than the reality, and the reality is expensive enough on its own.

Worked example
What a lapsed number cost one household
A family last filed with the mother's ITIN on the 2022 return. They had no filing obligation for the next three years, so the number went unused and lapsed on December 31, 2026.

In the following filing season they had income again and filed in early February — with the lapsed number, because nobody had told them it lapses. The return was accepted. The $500 Credit for Other Dependents claimed for their younger child was held back pending the number, and the refund came several months late and short.

The fix was a renewal filed in February, inside the January 15 through April 30 window, so it took the long 9-to-11-week route. Filed the previous October, the same renewal would have taken 7 weeks and cost them nothing at all. The lesson is entirely about timing.

How to renew

A renewal is the same Form W-7 as a new application, marked as a renewal, with the same document standard.

  1. Complete Form W-7 and mark it as a renewal
    Not a new application. Marking a renewal as new creates a duplicate record instead of reviving your history, and the IRS then has to unpick it.
  2. Enter the ITIN you are renewing
    The number itself, exactly as issued. It is on your CP565 notice and on any return you filed with it.
  3. Attach your supporting documents
    Originals or copies certified by the agency that issued them — the same standard as a new application, and notarised copies are not accepted here either. A valid passport still covers both columns on its own.
  4. Attach a tax return only if you need to
    You can renew ahead of season without one. But a spouse or dependent renewing in order to be claimed for a tax benefit must be listed on an attached federal return.
  5. Submit by any of the three routes

Renew the household together. If more than one number on your return is lapsing, they can all be renewed in one package. Finding the second lapsed number after the first renewal is already in the post costs another full processing cycle.

When to renew — the timing that saves you weeks

The processing windows are the same as for a new application, which makes the timing decision straightforward.

Applying between January 15 through April 30 puts you in the queue with every new applicant of the filing season. Renewing in the autumn, when the reason to renew is already visible, uses the shorter window and takes the deadline pressure out of it entirely. If you know you will file next spring with a number that lapses on December 31, 2026, renewing now is free and costs you nothing but a stamp.

The old middle-digit schedule, and why it no longer applies

For several years the IRS ran a rolling programme that retired ITINs by their fourth and fifth digits — one block of middle digits each year — alongside the non-use rule. A great deal of material online still describes that schedule and tells you to check your middle digits against a table.

That programme ran its course. What governs now is the three-year non-use rule, and that is the only test on this page. If a guide asks you to look up your middle digits to find your expiry year, check its date before you act on anything else it says.
