Self-Employed With an ITIN: 1099s, Schedule C and SE Tax
What actually happens on the return when your business or gig income is reported against an ITIN — which schedules, which tax, which deductions survive, and which credits do not.

An ITIN is a valid taxpayer number for reporting business income, so a platform or client can issue you a Form 1099 against it and you file the same way anyone else does — Schedule C for the profit, Schedule SE for self-employment tax if you file as a resident, and quarterly estimated payments if nothing is being withheld. Every ordinary business deduction is still available. What you lose is on the credit side: no Earned Income Tax Credit and no Child Tax Credit. And an ITIN is not work authorization — that is a separate question.

The 1099 you receive
An ITIN is a valid taxpayer identification number for information reporting. When you give it to a platform or a client on a Form W-9 equivalent, they can report payments against it in the ordinary way.
- Form 1099-NEC is the usual form for payments for services from a client or a platform that treats you as a contractor.
- Form 1099-K comes from payment processors and marketplaces reporting the gross amount that passed through them — note gross, before their fees, which is why the number often looks too high.
- A number that only appears on information returns like these does not have to be renewed for that purpose, even after it expires for filing.
Which return, and whether self-employment tax applies
This is the question where holding an ITIN is genuinely irrelevant and something else decides. Your residency status for tax purposes is what governs, and it is a day-count test, not an immigration category.

Deductions you can still take, in full
Here is the good news, and it is worth stating plainly because a lot of ITIN holders assume the opposite: business deductions do not depend on which taxpayer number you hold. The test is whether an expense was ordinary and necessary for the business. That is it.

Quarterly payments
Nobody withholds tax from a 1099. If you expect to owe, the tax is due in instalments through the year, and the rule applies the same way regardless of which number you hold.

Credits: where an ITIN costs a self-employed filer most
Deductions survive intact. Credits do not, and for a self-employed filer on a modest income the gap is larger than it looks, because the credit an ITIN cannot reach is often the biggest one on the return.

Expiry, when business income is your only activity
A quiet trap sits here. An ITIN that is not used on a U.S. federal tax return for three consecutive tax years expires on December 31 of that third year. An information return is not a tax return, so receiving a 1099 every year does not keep your number alive for filing purposes.
The practical case: someone with a few years of small gig income below the filing threshold, who therefore does not file. The 1099s keep arriving; the number quietly lapses. The year the income grows enough to require a return, the number is expired, the return is delayed, and credits sit disallowed until it is renewed. A worked example, start to finish
Step 1 — start from gross, not from the bank. Schedule C line one is the $41,000, not the roughly $31,000 that reached his account.
Step 2 — deduct the platform's cut. Around $10,000 in commission and service fees, taken from the annual statement. This is the step that reconciles the 1099-K to reality, and skipping it is how people overpay badly.
Step 3 — deduct the mileage. With a contemporaneous log, business miles at the current standard rate. For a full-time driver this is usually the largest single deduction on the return, and it is fully available with an ITIN. Run it on the mileage calculator.
Step 4 — the remaining expenses. Phone, the business share of car washes and supplies, any tolls not reimbursed.
Step 5 — self-employment tax on the net. Because Carlos files as a resident, Schedule SE applies to net earnings. Half of that tax then comes back as a deduction.
Step 6 — the credits, and what is missing. On this income with a family, an SSN holder would likely be looking at a meaningful Earned Income Tax Credit and the Child Tax Credit. An ITIN lets you report the income and pay the tax. It does not give you permission to do the work — the IRS states plainly that an ITIN does not authorize you to work legally in the United States, and work authorization comes from your immigration status. Do I pay self-employment tax with an ITIN?
